The Immigration and Refugee Board of Canada (IRB) has issued a Practice notice: Use of artificial intelligence (AI) in IRB proceedings. This clearly explains to parties that they are responsible for the accuracy of everything they submit to the IRB, including when they use AI to produce and/or translate their documents. It highlights key things they should consider when using AI, in light of this responsibility. The notice applies to all divisions and comes into force on September 7, 2026.
Any use of AI by people working at the Board is governed by internal policies and directives that prohibit using AI when preparing and deciding cases and explain what safeguards must be in place when using AI in non-adjudicative work. This includes the core expectation that people who use AI remain accountable for the quality and accuracy of the work they produce.
Together, these guidance documents establish how the IRB is maintaining its ongoing commitment to timely, quality decision-making as AI tools become more widely available and continue to evolve.
